#JAMES Immo provides a comprehensive online marketing tool that property owners and real estate agents can utilize to promote their properties. However, we do not guarantee the accuracy, completeness, or reliability of the information provided by property owners or real estate agents.

Contact with Real Estate Agents:

Any inquiries or communication regarding properties listed on the Website will be directed to the responsible real estate agent who has the contractual agreement with #JAMES Immo. We do not participate in or control the communication between users and real estate agents.

Limitation of Liability:

#JAMES Immo shall not be liable for any damages, losses, or disputes arising from the existence or contents of the contract between the property owner and the responsible real estate agent. Users acknowledge that any transactions or agreements made are solely between them and the respective real estate agent.

Subscription-Based Business Model:

#JAMES Immo operates on a subscription-based business model for online marketing activities. Fees for the promotion of properties are paid by either the property owner or the real estate agent representing the owner in selling the property.

Legal Compliance:

Users of the Website are responsible for ensuring compliance with all applicable laws, regulations, and guidelines, including those related to real estate transactions, consumer protection, and data privacy.

Intellectual Rights

#JAMES Immo is the owner or licensee of the intellectual rights relating to the entire content of the Platform, including the tools, functionalities, texts, graphics, logos, images, code database and icons provided by it. #JAMES Immo. is protected by intellectual property rights such as copyright and the rights of the producer of the database, and the various tools made available to the User.

The design of the Platform (plan, choice and arrangement of sections, organisation of data, etc.) are protected by the legal policy on copyright. #JAMES Immo prohibits the reuse of the entire content of the Platform or any qualitative or quantitative part of it. Transposition of European Directive No 96/9/EC provides that infringement of these rights is subject to penalties ranging up to €500,000 fine and, in case of repetition, up to 2 years’ imprisonment.


#JAMES Immo expressly prohibits the automated or systematic reading or copying of part or all of the Platform (images, data, etc.) for any purpose and in any way, and regardless of the technical means used (such as scraping, etc.). This also refers, inter alia , to the prohibition of automated scrapping or any other use of the content of the Platform for training artificial intelligence or similar technology.

exercises its right to object to text and data mining. In this clause, “text and data mining” means any automated analysis technique aimed at analysing text and data in digital form to generate information that includes, but is not limited to, patterns, trends and correlations.

This right to object applies to all content, data and websites to which #JAMES Immo provides access. 
For this reason, #JAMES Immo expressly refuses in a general and non-exhaustive manner, the use of its content for:


– the data mining, data collection or extraction method;
 – the development and training of artificial intelligence systems;
 – the development of any software program.
 
#JAMES Immo grants the User of the platform a non-exclusive, non-transferable and revocable licence, revocable at any time without reason, to access, display and download the content on a computer for the sole purpose of consulting such content. The User may also print a copy of the content displayed on the Platform for their personal use only, provided that they do not modify the content of the Platform in any way and that they retain all indications of authorship and origin of the Platform. Consequently, reproduction is authorised exclusively for personal use and as a personal copy within the meaning of the Copyright Act.

Advertising a property

All texts, data, photos, videos, messages or any other form of content posted by or for a User,  on the Platform is under its sole responsibility. #JAMES Immo cannot be held responsible for the content posted by Users on the Platform. 

As a User of the Platform’s advertising service, you undertake not to post any content that expresses a political opinion, has defamatory, racist or xenophobic connotations or incites discrimination, hatred or violence against any person, group, community or their members, on the basis of an alleged race, colour, descent or national or ethnic origin of one or more of them.


The User guarantees that any add published on the Platform meets the quality criteria that a visitor to the Platform may reasonably expect: the description of the property for sale or rent and the conditions of sale and rental must be correct, clear and unambiguous. The elements of the description of the wanted property must be entered in the fields provided. 
#JAMES Immo may delete any incorrect or misleading ads at any time, in accordance with the provisions in the section “Restrictions on the publication of ads” below.

 

Governing Law:

This disclaimer shall be governed by and construed in accordance with the laws of Belgium. Any disputes arising out of or in connection with this disclaimer shall be subject to the exclusive jurisdiction of the courts of Belgium.

By accessing or using the Website, users acknowledge that they have read, understood, and agree to be bound by this disclaimer.
